1. Who you are contracting with
This shop is operated by Maximilian Schäfer, trading as Nordhem Living, Berliner Allee 54, 15806 Zossen, Germany. Full details are on our Legal Notice page.
2. Scope
These terms apply to all orders placed through nordhemliving.com by consumers and business customers. Your own terms do not apply unless we have agreed to them in writing.
3. How a contract is formed
The products shown in the shop are an invitation to order, not a binding offer. You place a binding order by completing checkout. We confirm receipt of your order by email, which is not yet acceptance. The contract comes into effect when we accept your order or dispatch the goods.
4. Prices
All prices are in euro and are final prices. In accordance with the small business regulation under section 19 of the German VAT Act (§ 19 UStG), we do not charge value added tax and do not show it separately. Shipping costs are shown separately before you complete checkout and are listed on our Shipping Policy page.
5. Payment
Payment is due at the time of ordering. Available payment methods are shown at checkout and listed on our Payment Policy page. Payments are processed by our payment provider, and we do not receive or store your full card details.
6. Delivery
Goods are dispatched by our production partners abroad and delivered directly to you. Normal delivery is 10 to 20 days from the day you order. Delivery times are estimates and are not binding delivery dates unless we have expressly agreed one with you.
7. Retention of title
The goods remain our property until paid for in full.
8. Right of withdrawal and voluntary returns
Consumers have a statutory 14 day right of withdrawal. The full instructions and the model withdrawal form are on our Right of Withdrawal page.
In addition, and voluntarily, we accept returns for any reason within 30 days of delivery on the conditions set out in our Return and Refund Policy. This voluntary right does not limit or replace the statutory right of withdrawal.
9. Faulty goods
The statutory rules on liability for defects apply. Nothing in these terms limits your statutory rights as a consumer.
10. Liability
We are liable without limitation for damages arising from injury to life, body or health, and for damages caused intentionally or by gross negligence. For slight negligence we are liable only where an obligation essential to the purpose of the contract has been breached, and then only for foreseeable damage typical of this kind of contract. Liability under the German Product Liability Act is not affected.
11. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
12. Dispute resolution
The EU online dispute resolution platform is available at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
13. Severability
If any provision of these terms is or becomes invalid, the remainder stays in force.
